Last Stand Farm and Equipment Rentals L.L.C. is a Missouri family farm and farm stand dedicated to providing fresh, locally grown agricultural products and related goods to our community. Our offerings include, but are not limited to:
Fresh fruits, vegetables, and eggs, grown and produced seasonally on our farm.
Homemade baked goods, including breads, pastries, pies, and similar items.
Canned goods, including jams, jellies, preserves, and other home-processed products.
Equipment rentals for agricultural and related business / personal use.
We are a family-operated business committed to quality, transparency, and honest dealing with every customer we serve.
Last Stand Farm and Equipment Rentals L.L.C. operates within the State of Missouri, United States of America. All operations, transactions, products, and services offered by Last Stand Farm and Equipment Rentals L.L.C. are subject to the laws and regulations of the State of Missouri, including applicable federal law. Nothing in these Terms shall be construed to limit any rights or protections available to customers under applicable law.
Fresh fruits, vegetables, and eggs offered at Last Stand Farm and Equipment Rentals L.L.C. are subject to seasonal availability. The Farm makes no guarantee that any specific fruit, vegetable, egg, or produce item will be available at any given time. Quantities of all produce items are limited and are sold on a first-come, first-served basis. All fresh produce and eggs are sold as-is directly from the farm and are subject to the natural variations inherent in agricultural products, including variations in size, color, shape, and appearance.
Homemade baked goods and canned goods (including jams, jellies, and preserves) offered by Last Stand Farm and Equipment Rentals L.L.C. are produced and sold pursuant to the Missouri Cottage Food Law, RSMo § 196.298, as amended August 28, 2022.

This disclosure applies to all baked goods and canned products sold by Last Stand Farm and Equipment Rentals L.L.C. These products are prepared in a home kitchen that is not subject to routine inspection by any state regulatory authority. Cottage food products may only be sold within the State of Missouri and may not be sold across state lines.
All sales are final. Due to the perishable nature of farm-direct food products, no returns or refunds will be accepted on fresh produce, baked goods, or canned goods, with the following limited exception: a documented quality defect reported to Last Stand Farm and Equipment Rentals L.L.C. in writing or in person within twenty-four (24) hours of the date and time of purchase may, at the Farm's sole discretion, result in a replacement product or store credit. No cash refunds will be issued except as required by applicable Missouri law.
Customers must inspect all canned goods before consuming. Do not use any canned product if the lid is bulging, dented, cracked, compromised, or if the product shows any signs of spoilage, unusual odor, or discoloration. When in doubt, discard the product. Consuming improperly sealed or spoiled canned goods may cause serious illness, including botulism. Last Stand Farm and Equipment Rentals L.L.C. shall not be responsible for illness or injury resulting from failure to inspect products prior to consumption.
Last Stand Farm and Equipment Rentals L.L.C. reserves the right to substitute comparable products of equal or greater value if a specific pre-ordered or requested item is unavailable at the time of fulfillment. Customers will be notified of any substitution prior to or at the time of pickup, and may decline the substitution and receive a full refund for the unavailable item only.
Last Stand Farm and Equipment Rentals L.L.C. grows and produces its products using good agricultural practices and takes reasonable care to provide safe, quality goods to its customers. However, the Farm makes no express or implied warranties regarding freedom from allergens, pesticide or herbicide residue, specific nutritional content, or any other quality standard not expressly stated herein. Products are sold "as-is" as a natural agricultural product.
Baked goods and canned goods produced and sold by Last Stand Farm and Equipment Rentals L.L.C. may contain or have come into contact with wheat, dairy (milk), eggs, tree nuts, peanuts, soy, sesame, and other common food allergens. Products are prepared in a home kitchen environment where cross-contamination is possible. Customers with known or suspected food allergies or sensitivities must inquire with Last Stand Farm and Equipment Rentals L.L.C. staff before making any purchase. Last Stand Farm and Equipment Rentals L.L.C. shall not be liable for any allergic reaction resulting from failure to disclose a known allergy or failure to inquire about product ingredients.
All raw agricultural products, including fresh fruits, vegetables, and eggs, should be thoroughly washed before consumption. Eggs should be refrigerated promptly and cooked to safe internal temperatures before eating. Certain products may require cooking to appropriate internal temperatures before eating. Last Stand Farm and Equipment Rentals L.L.C. is not responsible for illness, injury, or adverse health effects resulting from a customer's failure to properly wash, handle, store, refrigerate, or cook farm-direct products after purchase.
Consistent with the requirements of RSMo § 196.298 (Missouri Cottage Food Law, as amended August 28, 2022), cottage food products sold by Last Stand Farm and Equipment Rentals L.L.C. — including baked goods and canned goods — are not inspected by the State of Missouri or any state regulatory agency. Customers purchase and consume cottage food products at their own risk.
By purchasing food products from Last Stand Farm and Equipment Rentals L.L.C., customers knowingly and voluntarily acknowledge and accept all food safety risks associated with the purchase and consumption of farm-direct, locally produced, and cottage food products. This assumption of risk is a material condition of sale.
Equipment rentals are available only to individuals who are eighteen (18) years of age or older. Proof of age is required at the time of rental. By entering into a rental agreement, the Customer represents and warrants that they meet all eligibility requirements set forth in these Terms and in the individual rental agreement.
At the time of equipment pickup, the Customer must present:
A valid, government-issued photo identification (e.g., driver's license, state-issued ID, or U.S. passport).
A fully executed, signed rental agreement specific to the equipment being rented.
No equipment will be released without both of these items. Last Stand Farm and Equipment Rentals L.L.C. reserves the right to refuse rental to any individual who cannot produce the required documentation.
A refundable security deposit is required prior to or at the time of equipment pickup. The deposit amount will be determined at the time of rental based on the type, condition, and replacement value of the equipment. The security deposit will be returned to the Customer upon return of the equipment in satisfactory condition, as determined by Last Stand Farm and Equipment Rentals L.L.C. in its reasonable discretion, subject to the damage and deduction provisions of Section 4.7 below.
The rental period, applicable daily or hourly rate, and total estimated rental charges will be stated in the individual rental agreement executed at the time of pickup. Late returns: Equipment returned after the agreed-upon return date and time may incur additional daily rental charges at the standard rate, which will be deducted from the security deposit or billed to the Customer, at Last Stand Farm and Equipment Rentals L.L.C.'s election.
From the moment of equipment pickup through the moment of return and acceptance by Last Stand Farm and Equipment Rentals L.L.C., the Customer assumes full responsibility for the rented equipment, including:
Loss or theft of the equipment
All damage to the equipment, whether accidental or otherwise.
Any injuries to persons caused by the Customer's use of the equipment.
Any property damage caused by the Customer's use of the equipment.
Safe transport of the equipment to and from the Farm.
All rented equipment must be returned in the same condition as it was rented, subject to normal wear and tear as determined by Last Stand Farm and Equipment Rentals L.L.C.. Equipment must be returned:
Cleaned: Free of excessive dirt, mud, debris, or contaminants
Fueled (where applicable): With fuel levels restored to the level at the time of rental.
Failure to return equipment in the required condition may result in cleaning or fueling charges deducted from the security deposit.
If rented equipment is returned in a damaged condition beyond normal wear and tear, the Customer shall be financially liable for the full cost of repair or replacement of the damaged equipment, as determined by Last Stand Farm and Equipment Rentals L.L.C. in good faith. The security deposit will be applied first toward any repair or replacement costs. If the cost of repair or replacement exceeds the security deposit amount, the Customer agrees to pay the remaining balance promptly upon demand. Last Stand Farm and Equipment Rentals L.L.C. reserves the right to pursue all available legal remedies to recover amounts owed.
The Customer agrees that rented equipment shall not be:
Subleased, lent, or transferred to any third party.
Used for any purpose other than the purpose agreed upon in the rental agreement.
Used in a manner that violates any applicable law, regulation, or ordinance.
Violation of this section shall constitute grounds for immediate termination of the rental agreement, forfeiture of the security deposit, and potential legal action.
Last Stand Farm and Equipment Rentals L.L.C. makes no warranty of fitness for a particular purpose and no implied warranty of merchantability with respect to any rented equipment. The Customer is responsible for inspecting all rented equipment before use and for reporting any pre- existing damage, defects, or concerns to Last Stand Farm and Equipment Rentals L.L.C. staff prior to leaving the premises. Failure to report pre-existing damage before departure may result in the Customer being held liable for such damage upon return.
Last Stand Farm and Equipment Rentals L.L.C. shall not be liable for any personal injuries, death, or property damage resulting from the Customer's use or misuse of rented equipment. Customer's use of rented equipment is entirely at the Customer's own risk.

Major credit and debit cards, where processing equipment is available at the time of sale. Card acceptance is subject to change without notice.
All prices are subject to change without prior notice. Prices displayed at the farm stand or communicated verbally by staff are valid at the time of purchase only and shall not be guaranteed for any future transaction.
Missouri sales tax will be applied to all applicable purchases in accordance with the Missouri Sales Tax Law, Chapter 144, RSMo. Certain food products may be exempt from Missouri sales tax pursuant to RSMo § 144.049. Sales tax will be collected and remitted in compliance with current Missouri Department of Revenue requirements and guidance. The applicable tax rate is determined by the Farm's location and the nature of the product sold.
Security deposits for equipment rentals must be paid in full at the time of reservation or pickup, whichever occurs first. No equipment will be released to a Customer until the required deposit has been received by Last Stand Farm and Equipment Rentals L.L.C.
A returned check fee of $35.00 will be charged for any check returned unpaid by the Customer's financial institution for any reason, including but not limited to insufficient funds, account closed, or payment stopped. Last Stand Farm and Equipment Rentals L.L.C. reserves the right to require cash- only payment from any Customer who has had one or more checks returned. The Customer remains liable for the full original amount of the purchase plus the returned check fee. Last Stand Farm and Equipment Rentals L.L.C. reserves all rights available under Missouri law to collect unpaid amounts.
No pricing disputes will be accepted after a purchase has been completed and a receipt has been issued to the Customer. Customers are encouraged to verify prices and confirm totals before completing any transaction.
Pre-orders must be picked up within the agreed-upon pickup window communicated to the Customer at the time the order is placed. Orders not retrieved within [X] hours of the scheduled pickup time may be forfeited without refund, at the sole discretion of Last Stand Farm and Equipment Rentals L.L.C. The Farm will make reasonable efforts to contact Customers regarding unclaimed orders; however, Last Stand Farm and Equipment Rentals L.L.C. is not obligated to hold perishable items beyond the designated window.
Last Stand Farm and Equipment Rentals L.L.C. is not responsible for any degradation in product quality, spoilage, or loss arising from the Customer's failure to pick up products within the scheduled window. Once the scheduled pickup window has passed, any risk of quality loss passes to the Customer.
The Last Stand Farm and Equipment Rentals L.L.C. farm stand operates on a seasonal schedule. Hours of operation, open dates, and product availability are subject to change at any time and without prior notice due to seasonal conditions, weather, harvest schedules, equipment needs, and other operational factors. Customers are encouraged to contact Last Stand Farm and Equipment
Customers are solely responsible for providing appropriate containers, bags, coolers, and transportation for all purchased perishable products. Last Stand Farm and Equipment Rentals L.L.C. does not guarantee the availability of packaging materials at the farm stand. Proper handling and refrigeration of perishable items after purchase is the Customer's responsibility.
Last Stand Farm and Equipment Rentals L.L.C. reserves the right to refuse service, cancel a pre- order, or require a Customer to leave the premises if that Customer is disruptive, disrespectful toward staff or other customers, in violation of these Terms, or engages in any behavior that Last Stand Farm and Equipment Rentals L.L.C. reasonably determines to be harmful, threatening, or inappropriate.
Entry onto Last Stand Farm and Equipment Rentals L.L.C. property is at the Customer's own risk. Last Stand Farm and Equipment Rentals L.L.C. is a working agricultural operation, and as such, presents inherent hazards that differ substantially from a retail commercial environment. These hazards include, but are not limited to:
Farm equipment and machinery in operation.
Uneven, unpaved, or muddy terrain.
Livestock, poultry, and other farm animals.
Open ditches, ponds, irrigation features, and water hazards.
Seasonal weather conditions, including extreme heat, precipitation, and ice.
Chemicals and products used in agricultural production.
Customers are expected to exercise reasonable caution and situational awareness at all times while on farm property.
Children must be supervised by a parent or guardian at all times while on Last Stand Farm and Equipment Rentals L.L.C. property. Children may not operate or approach farm equipment or enter areas housing animals or hazardous materials under any circumstances. The parent or guardian accompanying a minor accepts full responsibility for that child's safety and conduct while on the premises.
Customers must remain on designated public pathways and customer areas at all times. Entry into restricted, working, or private areas of the farm is strictly prohibited unless the Customer is expressly accompanied by a member of Last Stand Farm and Equipment Rentals L.L.C. staff. Restricted areas will be marked or communicated verbally by staff. Unauthorized access to restricted areas constitutes a breach of these Terms and may result in removal from the premises.
Last Stand Farm and Equipment Rentals L.L.C., its owners, operators, employees, family members, heirs, agents, and assigns shall not be liable for any personal injury, death, or property damage sustained on farm premises arising from any cause, including the alleged negligence of Last Stand Farm and Equipment Rentals L.L.C. or its representatives, to the fullest extent permitted by applicable Missouri law. Customers expressly agree that they waive any such claims against Last Stand Farm and Equipment Rentals L.L.C. as a condition of entering the premises.
See Missouri premises liability standards and relevant provisions under RSMo Chapter 537 (Torts and Actions for Damages).
By entering the premises of Last Stand Farm and Equipment Rentals L.L.C., each Customer voluntarily assumes all risks of injury, illness, or property damage associated with visiting and participating in the activities of a working farm, including all risks arising from the inherent hazards described in Section 7.1 above.
To the fullest extent permitted by applicable Missouri law, Last Stand Farm and Equipment Rentals L.L.C.'s total liability for any claim, loss, damage, or expense of any kind arising from or related to products purchased or services rendered by Last Stand Farm and Equipment Rentals L.L.C. shall not exceed the total amount actually paid by the Customer to Last Stand Farm and Equipment Rentals L.L.C. for the specific product or service that directly gives rise to the claim. This limitation applies to all theories of recovery, whether in contract, tort, equity, or otherwise.
Under no circumstances shall Last Stand Farm and Equipment Rentals L.L.C. be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to these Terms, any transaction, or any use of farm products or services, even if Last Stand Farm and Equipment Rentals L.L.C. has been advised of the possibility of such damages.
The limitations set forth in this Section 8 shall apply regardless of the legal theory or cause of action asserted, including but not limited to claims arising in contract, tort, negligence, strict liability, breach of warranty, product liability, or any other legal or equitable theory.
To the fullest extent permitted by Missouri law, the Customer agrees to indemnify, defend, and hold harmless Last Stand Farm and Equipment Rentals L.L.C., its owners, principals, employees, family members, heirs, successors, agents, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, losses, damages, liabilities, costs, and expenses, including reasonable
The Customer's purchase, handling, storage, preparation, or consumption of farm products.
The Customer's presence on, or access to, Last Stand Farm and Equipment Rentals L.L.C. property.
The Customer's breach or violation of any provision of these Terms.
The Customer's misuse, improper operation, or unauthorized use of rented equipment.
Any negligent or intentional act or omission by the Customer or any person accompanying the Customer.
This indemnification obligation shall survive the termination or expiration of any rental agreement or purchase transaction between the parties.
These Terms and Conditions, and any dispute, controversy, or claim arising out of or related to them or any transaction with Last Stand Farm and Equipment Rentals L.L.C., shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to any conflict- of-law provisions or principles that would require the application of the law of any other jurisdiction.
Any formal legal proceeding arising under these Terms shall be subject to the exclusive jurisdiction and venue of the appropriate state or federal courts located within the State of Missouri. Both parties consent to personal jurisdiction in the State of Missouri and waive any objection to venue in such courts.
Prior to initiating any formal legal proceeding, the parties agree to make a good-faith effort to resolve any dispute informally. The Customer agrees to contact Last Stand Farm and Equipment Rentals L.L.C. directly in writing, describing the nature of the dispute and the relief sought, and allow Last Stand Farm and Equipment Rentals L.L.C. a period of thirty (30) calendar days to respond and attempt resolution before pursuing formal legal action.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unenforceable, or contrary to applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, it shall be severed from these Terms. All remaining provisions of these Terms shall continue in full force and effect and shall not be affected by the invalidity of any severed provision.
Baked goods and canned goods sold by Last Stand Farm and Equipment Rentals L.L.C. are produced and sold pursuant to the Missouri Cottage Food Law, RSMo § 196.298, as amended effective August 28, 2022. These products:
Are prepared in a home kitchen that is not subject to inspection by the Missouri Department of Health and Senior Services.
May only be sold within the State of Missouri.
May not be sold, shipped, or distributed across state lines.
All cottage food products sold by Last Stand Farm and Equipment Rentals L.L.C. are labeled in compliance with the disclosure requirements of RSMo § 196.298.
Fresh produce sold at the Last Stand Farm and Equipment Rentals L.L.C. farm stand is subject to applicable Missouri Department of Agriculture produce safety guidelines and regulations. Last Stand Farm and Equipment Rentals L.L.C. endeavors to comply with all applicable state agricultural standards for the growing, harvesting, and handling of fresh produce.
Missouri sales tax will be applied to applicable purchases in accordance with the Missouri Sales Tax Law (Chapter 144, RSMo). Certain food items may qualify for an exemption from Missouri sales tax under RSMo § 144.049. Tax will be collected in accordance with then-current Missouri law and Department of Revenue guidance. Customers should retain their receipts for their records.
Any legal claim arising out of or related to these Terms, a transaction with Last Stand Farm and Equipment Rentals L.L.C., or the Customer's presence on farm property must be brought within the applicable limitations period established by Missouri law. See RSMo Chapter 516 (Limitations of Actions) for the applicable periods governing various types of claims, including five (5) years for written contract claims and five (5) years for personal property damage claims under RSMo § 516.120. Failure to bring a claim within the applicable period shall result in permanent bar of that claim.
To the fullest extent permitted by the laws of the State of Missouri, both Last Stand Farm and Equipment Rentals L.L.C. and the Customer knowingly, voluntarily, and intentionally waive their respective rights to a trial by jury in any action, proceeding, or counterclaim arising out of or related to these Terms, any purchase transaction, equipment rental, or visit to farm property. This waiver is a material inducement to Last Stand Farm and Equipment Rentals L.L.C. to make its products, services, and premises available to Customers. Each party represents that it has had the opportunity to review this jury trial waiver provision with legal counsel.
Customers must treat all Last Stand Farm and Equipment Rentals L.L.C. staff, employees, family members, property, and fellow customers with courtesy and respect at all times while on farm premises or in any communication with the Farm. Abusive, threatening, harassing, or disrespectful conduct will not be tolerated and will result in immediate removal from the premises and potential refusal of future service.
The following are strictly prohibited anywhere on Last Stand Farm and Equipment Rentals L.L.C. property:
Smoking, vaping, or use of tobacco products of any kind.
Consumption of alcoholic beverages, unless expressly authorized by Last Stand Farm and Equipment Rentals L.L.C. for a specific event.
Use, possession, or distribution of any illegal substances or controlled materials.
Violation of this policy will result in immediate removal from the premises and, where applicable, notification of law enforcement.
Pets are permitted on Last Stand Farm and Equipment Rentals L.L.C. property subject to the following conditions:
All pets must be kept on a leash or otherwise physically restrained and under the direct control of their owner at all times.
Pet owners are solely responsible for any injury to persons, damage to property, or harm caused by their pet while on farm premises.
Last Stand Farm and Equipment Rentals L.L.C. reserves the right to require a pet owner to remove their animal if the animal poses a risk to persons, livestock, or property.
Littering on Last Stand Farm and Equipment Rentals L.L.C. property is strictly prohibited. Customers are expected to dispose of all waste in designated receptacles. Customers who fail to comply may be asked to leave the premises.
Customers are welcome to take personal, non-commercial photographs on Last Stand Farm and Equipment Rentals L.L.C. property for personal use and personal social media sharing. The following uses are expressly prohibited without the prior written consent of Last Stand Farm and Equipment Rentals L.L.C.:
Photography or video recording of Last Stand Farm and Equipment Rentals L.L.C. employees or staff without their explicit consent.
Photography or video in designated private, restricted, or operational areas of the farm.
Use of any photographs, video, or imagery featuring Last Stand Farm and Equipment Rentals L.L.C. branding, property, or products for any commercial purpose, advertisement, paid promotion, or commercial social media activity.
Requests for commercial photography or media use should be directed to Last Stand Farm and Equipment Rentals L.L.C. in advance. Last Stand Farm and Equipment Rentals L.L.C. reserves all intellectual property rights in its branding, trade dress, and proprietary farm imagery.
Last Stand Farm and Equipment Rentals L.L.C. reserves the right, at any time and in its sole discretion, to require any Customer to leave the farm premises for violation of these Terms, disruptive behavior, or any conduct that the Farm reasonably determines to be harmful, unsafe, or detrimental to the farm environment or the experience of other customers. No refund will be owed for any unconsumed portion of a purchase in the event of removal for cause.
Last Stand Farm and Equipment Rentals L.L.C. reserves the right to update, revise, or modify these Terms and Conditions at any time and for any reason, in its sole discretion. Such modifications may be made to reflect changes in Missouri law or regulations, changes in Farm operations or offerings, or for any other business reason.
Updated or revised Terms will be posted at the Last Stand Farm and Equipment Rentals L.L.C. farm stand in a conspicuous location and, where applicable, on the Farm's official website. It is the Customer's responsibility to review these Terms periodically for any updates. Continued purchase of products from, use of services offered by, or presence on the property of Last Stand Farm and Equipment Rentals L.L.C. following the posting of updated Terms shall constitute the Customer's acceptance of and agreement to those revised Terms. If you do not agree to the revised Terms, you should discontinue your patronage of Last Stand Farm and Equipment Rentals L.L.C.
